1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of BotBard (the "Service"), available at https://www.botbard.ai. By creating an account, connecting a website, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

BotBard is an AI-powered tool that lets WordPress website owners make changes to their sites using natural-language instructions. You connect your WordPress website to BotBard and describe the change you want — for example, updating a headline, rewriting content, or modernizing a section — and BotBard helps prepare and apply those changes.

BotBard is a tool that assists you in editing your own website. It does not guarantee any particular outcome, ranking, traffic, revenue, or business result.

3. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract to use the Service.

You are responsible for the accuracy of the information you provide and for all activity that occurs under your account. Keep your account access (including the email inbox used to sign in) secure, and notify us promptly of any unauthorized use.

4. Your Responsibilities

• You may only connect WordPress websites that you own or are authorized to manage.
• You are responsible for maintaining your own backups of your website and content.
• You are responsible for reviewing every change before publishing it to your live site.
• You are responsible for ensuring your use of the Service complies with applicable laws and the terms of any third parties (including your hosting provider).

5. Connecting Your WordPress Website

To use the Service you install the BotBard plugin on your WordPress site and authorize a connection. This connection allows BotBard to read relevant site content and apply the changes you request. You can disconnect a site at any time from your BotBard dashboard or by removing the plugin, which revokes the connection.

6. AI-Generated Modifications

Changes suggested or applied by BotBard are generated using artificial intelligence based on your instructions. AI output can be imperfect, incomplete, or unexpected. BotBard prepares changes as a draft or preview wherever possible so you can review them first.

You are solely responsible for reviewing AI-generated changes and deciding whether to publish them to your live website. You should not publish a change you have not reviewed.

7. Backups and Recovery

BotBard provides tools such as draft previews and rollback of published changes to help you recover from an unwanted edit. These tools are provided as a convenience and are not a substitute for your own independent backups. We strongly recommend keeping regular backups of your website.

8. Acceptable Use

You agree not to use the Service to:

• Violate any law or infringe the rights of others, including intellectual property and privacy rights.
• Connect or modify a website you do not own or are not authorized to manage.
• Upload or generate content that is unlawful, harmful, deceptive, or malicious.
• Attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the Service or its infrastructure.
• Resell or provide the Service to third parties except as expressly permitted.

9. Subscriptions, Plans, and Payments

BotBard offers a free plan and one or more paid plans. Current plans, prices, and included monthly AI usage are shown on our Pricing page. Paid plans are billed on a recurring basis (for example, monthly) until cancelled.

Payments are processed by our third-party payment provider. By subscribing, you authorize us and our payment provider to charge your selected payment method for the applicable fees and any taxes. Prices may change; we will give reasonable notice of changes that affect your plan.

10. Usage Limits

Each plan includes a monthly AI usage allowance. If you reach your allowance, AI features may be paused until the next billing period or until you upgrade. We may apply reasonable technical limits to protect the Service and prevent abuse.

11. Cancellation

You may cancel your subscription at any time from your account or by contacting us. When you cancel, your plan remains active until the end of the current paid billing period, after which it will not renew. Cancelling stops future billing but is not by itself a refund of amounts already paid.

12. Refunds

Refunds are handled according to our Refund Policy, available at https://www.botbard.ai/refund. Please review it for eligibility and how to request a refund.

13. Intellectual Property

The Service, including the BotBard software, plugin, website, branding, and underlying technology, is owned by BotBard and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of the Service except as permitted.

14. Your Content and Website Ownership

You retain all rights to your website, your content, and the changes made to your site through the Service. We do not claim ownership of your website or content.

You grant BotBard the limited permission necessary to access, process, and modify your connected website and content solely to provide the Service at your direction.

15. Service Availability

We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control.

16. Third-Party Services

The Service relies on third-party providers — for example, hosting, email delivery, payment processing, and AI providers — to function. Your use of the Service may be subject to those providers' terms. BotBard is not responsible for the acts or omissions of third-party providers.

17. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by law. BotBard does not warrant that the Service or any AI-generated change will meet your requirements, be accurate, or be free of errors. You use the Service and publish changes at your own discretion and risk.

18. Limitation of Liability

To the maximum extent permitted by law, BotBard will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to BotBard for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory statutory rights as a consumer.

19. Suspension and Termination

We may suspend or terminate your access to the Service if you violate these Terms, if required to protect the Service or other users, or as otherwise permitted by law. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination will continue to apply.

20. Changes to the Service or Terms

We may update the Service and these Terms from time to time. When we make material changes to these Terms, we will update the date at the top of this page and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
